This grievance protests the company’s decision to terminate the employment of the three following employees: Holly Donaro, Ira Cash, and Mucha Yen. The union argues that the company’s actions violate the Collective Bargaining Agreement. The Union asks that the Company restores the positions of the individuals and make employees whole for the lost week of work.
On February 25th 2008, around noon, the cafeteria in the Student Activity Center was crowded, filled of employees. One of the cafeteria workers and several dining hall “greeters”, witnessed an unknown individual trying to shoplift food. Holly Donaro, the cafeteria worker, noticed a black “object” on the individual’s waistband. The greeters, Holly Donaro, Ira Cash, and Mucha Yen, noticed the same black object and concluded it to be a handgun. The employees reported the incident to the authorities who then sent an emergency alert to the entire company, resulting in a false alarm, hours later. The authority’s investigation found the employee’s inaccurate with many inconsistencies. The result was a man with no firearm and three employees with a false story. The facility manager, Ms. Stoney Brook, dismissed the mentioned employees above immediately after the investigation found the story to be false. In addition, the position of “greeter” was re-evaluated and discontinued. All the “greeters” are no longer working for Edison Credit Union due to the incident that occurred on February 25th, 2008. The “greeter” position was made in conjunction with the Collective Bargaining Agreement to help the company control traffic during the busy hours of lunch.
The Union timely grieved the Company’s decision to terminate the employees and their position. The Company rejected the grievance, whereupon the Union requested Arbitration.
