China’s Recent Antidumping and Subsidy Cases
On 13 September, 2009, MOFCOM officially issued a public notice, announcing that it commenced corresponding examination procedure concerning the initiation of antidumping and anti-subsidiary investigation towards auto parts and certain chicken products originating in the US.
1 Initiation of Antidumping and Subsidy Investigation against Chicken Products Originating in the US
On August 14, 2009, the Ministry of Commerce of the People’s Republic of China (hereinafter referred to as “MOFCOM”) duly received an antidumping and anti-subsidiary petition submitted by China Animal Agriculture Association, on behalf of domestic chicken products industry.
On September 13, 2009, MOFCOM issued the public notice mentioned above and commenced the examination procedure concerning the request of the initiation of antidumping and anti-subsidiary investigation against certain chicken products originating in the US. And after the examination of the petition, on September 27, 2009, MOFCOM issued another public notice and decided to initiate the antidumping and anti-subsidiary investigation against chicken products originating in the US.
The subject merchandise under investigation is broiler products or chicken products, and its HTS code under Customs Import and Export Tariff of the People’s Republic of China: 02071100、02071200、02071311、02071319、02071321、02071329、02071411、02071419、02071421、02071422、02071429 and 05040021. The period of investigation of the dumping investigation is from July 1, 2008 to June 30, 2009 and the period of investigation of the injury investigation is from January 1, 2006 to June 30, 2009.
According to the Initiation Notice, the respondent companies shall register with MOFCOM for participation of the investigation within 20 days from the date of initiation, i.e. October 19, 2009.
